Represented the HoltraChem Manufacturing Co. in the largest Occupational Safety and Health Administration (OSHA) fine in North Carolina history. Our team successfully negotiated a fine reduction from $1 million to $110,000 paid over 12 months. Subsequently, we defended our client in a suit brought by 71 individual plaintiffs/former employees seeking class action relief alleging various injuries from mercury poisoning. The plaintiffs’ counsel had brought a similar case in Georgia, in which our firm was not involved, that settled for more than $20 million. In our North Carolina case, the company chose to fight rather than settle. After several years of litigation, we won summary judgment which was upheld on appeal to the North Carolina Court of Appeals and the North Carolina Supreme Court.
