Represented the City of Winston-Salem and Forsyth County in constitutional litigation challenging the legality of economic development incentives given to Dell Inc. to build a manufacturing plant in the city and county. The case was the first appellate case challenging such incentives since the U.S. Supreme Court’s decision in Daimler-Chrysler v. Cuno, 547 U.S. 332 (2006), which declined to address the merits of the claims. The North Carolina Court of Appeals in this matter rejected the constitutional challenges to the incentives and ruled in favor of the City of Winston-Salem and Forsyth County. Case on appeal.
