Fred Whitmer presented on the topic of "Inequitable Conduct in the 21st Century, the Deadly Sins according to the Federal Circuit: Why playing fair in the Patent Office is an integral component of the duty of candor."
Mr. Whitmer focused on where applicants have run afoul of their duty and how to avoid conduct that may render a patent unenforceable. Focusing on the practical and legal considerations for potential patentees, the discussion identified some of the common sins of omission and commission that have robbed otherwise valid patents of the ability to exclude infringers and recover damages.
