The discussion will focus on where applicants have run afoul of their duty and how to avoid conduct that may render a patent unenforceable. Focusing on the practical and legal considerations for potential patentees, the discussion will identify some of the common sins of omission and commission that have robbed otherwise valid patents of the ability to exclude infringers and recover damages. Frederick L. Whitmer is a partner in the New York office of Kilpatrick Stockton LLP, where he focuses his practice in intellectual property and business litigation. His patent litigation experience has involved a wide array of technologies across many industries, ranging from the simple mechanical to complex computer software and systems patents, to medical devices and chemical products.
