David Smith concentrates his practice on business litigation at the trial and appellate levels. He represents plaintiffs and defendants in matters involving securities, shareholder rights, corporate governance and business torts and has a focus on litigation involving Native Americans.

Mr. Smith also has a robust construction and infrastructure practice. During his career, he has represented large general contractors, owners, developers and other companies with their construction litigation matters. This has included litigation related to defective design and materials, change orders and delay claims. Additionally, he has assisted large companies with the negotiation of construction contracts with foreign governments.

Mr. Smith was listed in The Best Lawyers in America® for Commercial Litigation in 2011 and 2012, is listed in the 2010 edition of Business North Carolina's “Legal Elite,” and s a 2010, 2011 and 2012 North Carolina "Super Lawyer" for Business Litigation in SuperLawyers magazine. Mr. Smith received the award for "North Carolina Lawyer of the Year" from The Legal Aid Society of Northwest North Carolina for pro bono legal services provided to the community for the years 2001-2004.
